Apply for a property and  affairs deputyship order

Use this service if you’re a solicitor, professional or if you are representing a Local Authority. There is a separate service for litigants in person

You will have the ability to use a ‘save for later’ button.

  • When you save your progress, you are asked to enter an email address and a security answer.
  • You will then receive an email with a one-off link that you can use to come back to the form and continue.
  • The link is valid for 28 days and will work only once.
  • You will enter the security answer to retrieve your saved answers. You will have 3 attempts to get it right. There is no recovery option if you lose the link or forget your security answer.
  • You can save progress as many times as you like by generating a new link each time.

You’ll be able to check your answers before you submit your application.

Before you continue

You or the applicant must have:

  • personally notified the person who may lack mental capacity
  • notified at least 3 other people connected to the application being made

You must have completed the relevant forms to apply to be a deputy. You’ll be asked to upload them in this service.

Naming your forms

To help the court process your application, each form uploaded should have a unique name.
Name your forms using the following format:

  • today’s date in the format year, month and day
  • the surname and first initial of the person who may lack mental capacity
  • the form name

For example, 2020-03-30-Smith-J-help-with-fees.pdf

Fees

The fees are detailed on the COP44 fees leaflet.

You must pay using an HMCTS Payment by Account (PBA) number.

You may be able to get help with paying the fees if the applicant has a low income or is on certain benefits. Fill in form COP44A to apply for help with fees.

Details you will need to provide

You will be asked to provide:

  • applicant contact details, including any joint applicants
  • solicitor contact details for all applicants
  • personal details of the person who may lack mental capacity
  • financial details of the person who may lack mental capacity, unless you are uploading a COP1A supplemental information form
  • notification details for each person notified

You will be able to check your answers before you send your application to the court.
